§ 1 Provider

Record Express is a brand of FFTEC-SOLUTIONS LLC, 7901 4th ST N STE 300, St. Petersburg FL 33702, USA. Full contact details are available in the imprint. These terms apply to all orders placed via record-express.com.

§ 2 Contract Formation

The product listing in the online shop is a non binding invitation to order. A contract is formed when the customer completes the design process, explicitly confirms the preview of cover, label, and tracklist, and completes payment. By confirming the preview, the customer acknowledges that the product will be manufactured exactly as shown. No changes are possible after this point, as production begins immediately.

§ 3 Prices and Payment

Prices are displayed in the currency selected in the online-designer. Any applicable statutory sales tax will be shown during the order process where required. Shipping costs are displayed before the order is completed. Payment is due upon completion of the order. Available payment methods are shown at checkout.

§ 4 Production and Delivery

Production time is 3 business days from receipt of payment. Delivery times by destination country are listed in the FAQ. All shipments include tracking; the tracking number will be sent by email. Risk of accidental loss passes to the customer upon handover of the goods to the shipping carrier.

§ 5 Copyright of Uploaded Content

By uploading audio files, images, or other content, the customer confirms that they hold the necessary rights to that content and that its use in production does not infringe any third party rights. The customer grants Record Express the usage rights necessary for production. Record Express accepts no liability for copyright infringements caused by the customer; the customer shall indemnify Record Express against any third party claims arising from such infringements. Record Express reserves the right to decline or suspend production of any order where there is reasonable suspicion of a rights infringement.

§ 6 Withdrawal and Defects

As all orders are individually manufactured products for which the customer's personal selection is decisive, no right of withdrawal applies, to the extent permitted under applicable law; mandatory consumer protection rights at the customer's place of residence remain unaffected. In the event of defects or production errors attributable to Record Express, the customer will receive a free replacement. Complaints must be submitted in writing with photographic documentation within 30 days of receipt. Color deviations from on screen representations within standard print tolerances, and sonic differences from digital sources that are inherent to the vinyl production process, do not constitute defects.

§ 7 Liability

Record Express is fully liable for intent and gross negligence, and for damages to life, body, and health. For minor negligence, Record Express is only liable for breach of a material contractual obligation, and only up to the foreseeable, contract typical damage. All further liability is excluded, in particular for infringements arising from content uploaded by the customer.

§ 8 Force Majeure

Record Express is not liable for delays or failures resulting from events of force majeure, including but not limited to natural disasters, pandemics, war or civil unrest, governmental action, failures of suppliers or shipping partners, and other circumstances beyond Record Express's reasonable control. In such cases, production and delivery timelines are extended accordingly; no claim for damages arises from such delays.

§ 9 Miscellaneous

The contract language is German or English. The contract text is not stored separately after order completion; the customer receives the key order details by email. Data protection is governed by the privacy policy at record-express.com. The EU Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr; we are not obligated to participate in such proceedings. Mandatory consumer protection provisions of the customer's country of residence within the EU remain unaffected. Otherwise, the law of the State of Delaware, USA applies. Should any provision be invalid, the remainder of the contract is unaffected.
